HEIs can choose which edition to copy from – there is no obligation to copy from the latest edition.
However, as in line with clause 3.4.4 (ii), and page 15 of the HE Licence User Guide, an HEI cannot use different editions of the same book to make copies as they would then breach extent limits. Having your DCS HEI Report open will help you determine if you've already copied from an earlier edition of the same title (just do a keyword search on the title). You can also use the search option on the DCS dashboard.
